1. Scope/Applicable law
The following general terms and conditions apply exclusively to the business relationship between us (www.schneider-modellbahnzubehoer.de) and you, including all resulting mutual claims, in the version valid at the time of the order. We do not recognize any deviating conditions unless we have expressly agreed to them in writing in individual cases.
These terms and conditions and the entire business relationship between us and you are governed by the laws of the Federal Republic of Germany. The provisions of the UN Convention on Contracts for the International Sale of Goods do not apply.

3. Conditions of order/purchase, VAT refund
www.schneider-modellbahnzubehoer.de concludes contracts with customers who
a) are natural persons of full legal capacity; with your order you confirm that you are of legal age,
b) are domestic legal persons.

4. Buyer’s information obligations
The buyer undertakes to provide only truthful information when registering. The buyer must inform us immediately of any changes to data that are important for the business relationship, in particular name, contact details and delivery address. If data provided by the buyer turns out to be incorrect or out of date, we are entitled to withdraw from contracts that have already been concluded and to close the customer account.
The buyer guarantees that the email address he has provided can be reached. If the customer cannot be reached, we are entitled to the above-mentioned rights.
If the use of the customer account requires a password, the customer is obliged to protect this against misuse and, as a precautionary measure, releases www.schneider-modellbahnzubehoer.de from all claims arising from the misuse of his customer account.

5. Confirmation of receipt and order confirmation
Our offers are non-binding and subject to change. The purchase contract is concluded when we accept your order by delivering the goods or by notifying you of the delivery. You waive receipt of an express declaration of acceptance, Section 151 Paragraph 1 of the German Civil Code (BGB). The confirmation of receipt and allocation of an order number by our system on the website immediately after the order process does not constitute an order confirmation.
Obvious errors, especially typographical and printing errors, are not binding.
We do not save the contract text and it can no longer be accessed after the order process has been completed. You have the option of printing out the order data immediately after sending it.

6. Right of withdrawal/return
The right of withdrawal/return is 14 days from receipt of the goods. Returns of goods and shipping costs must be borne by the customer. Any changes to the condition of the goods, including color changes, lead to the exclusion of the right of return.

7. Delivery time, availability reservation, partial deliveries
The delivery time can take up to 7 days. It usually takes between 2-3 working days. Furthermore, our liability for delays in delivery is excluded unless this is based on the violation of a cardinal obligation or a violation of legal interests of life, body or health. Partial deliveries are only made at your express request. If we make partial deliveries at your request, you must bear the additional costs incurred as a result.

8. Delivery conditions and shipping costs
Delivery is carried out by DHL (German parcel service). Shipping costs are calculated automatically after each order. After your purchase, you will receive an email with the total amount and our bank details.

9. Prices, payment
The prices on the day of your order apply. The stated € prices include German sales tax (VAT). When the goods are dispatched, the shipping costs stated above will also be charged.

10. Default in acceptance and payment
By offering the goods in accordance with the contract, the customer is in default of acceptance, with the result that the agreed purchase price becomes due and the legal consequences of default of acceptance occur.
In the event of late payment, www.schneider-modellbahnzubehoer.dee is entitled to charge a reminder fee of up to €10 per reminder, appropriate to the effort involved, unless you can prove that the actual costs incurred are significantly lower. The legal consequences of the delay remain unaffected by this, as does the right of www.schneider-modellbahnzubehoer.de to prove and charge for any greater reminder effort actually incurred.

11. Warranty
Obvious defects must be reported to us immediately upon receipt of the goods. To meet this deadline, it is sufficient to send your notification of defects in good time. We accept no liability for damage resulting from improper storage. Otherwise, our liability is limited to gross negligence and intent.
The above limitation of liability does not apply if the legal interests of life, body or health are affected. Any changes in the condition of the goods, including changes in color, will lead to the exclusion of the warranty.

12. In the event of a warranty claim
In the event of a warranty claim, you can simplify and speed up the process as follows:

Transport damage during delivery via DHL:
If the goods arrive damaged or the packaging shows transport damage, we ask you to note the complaint on the shipping delivery note and have the driver acknowledge the damage.
Delivery of goods other than those ordered
If you receive goods that do not correspond to your order (e.g. an incorrect product or the product in the wrong color, etc.), please contact us.

13. Retention of title
We retain title to the goods delivered (reserved goods) until all claims against the buyer, which we are entitled to now or in the future for any legal reason, have been fulfilled. This retention of title applies in any case as long as the purchase price of the goods delivered has not been paid in full. The buyer may only dispose of the reserved goods with the prior written consent of www.schneider-modellbahnzubehoer.de.
In the event of third parties – in particular bailiffs – accessing the reserved goods, the buyer will point out our ownership and notify us immediately so that we can protect our ownership rights.
The buyer will store the reserved goods for us free of charge. Any expenditure or use of the goods is at the buyer's own expense. Any claim for compensation is excluded.

14. Data protection

Your data will not be passed on to third parties, except where required by law.
According to Section 34 of the Federal Data Protection Act (BDSG), you have the right to request information free of charge about the data stored about you, including information about the origin of this data, the recipients or categories of recipients to whom the data is passed on and the purpose of the storage. You also have the right to have your personal data corrected, deleted and blocked under the legal requirements of Section 35 of the BDSG.

15. Severability Clause
Should one or more provisions of this contract be legally invalid in whole or in part or should they later lose their legal validity, this shall not affect the validity of the remainder of the contract. In this case, the parties undertake to replace the invalid provision with a valid provision that comes closest to the purpose intended by the invalid provision. The same applies if the contract contains a regulatory gap that was not intended by the parties.
